By using the NourishDoc Services, including by offering digital items and Guided Experiences (such as live, pre-recorded, or a combination thereof of bootcamps, workshops, masterclasses, group coaching sessions), and Wellness Certifications (credentialing programs offered by qualified Coaches) (collectively, a “Digital Product” or “Digital Products”), or other Coach-related content to any NourishDoc website or other Services, maintaining your NourishDoc account, or participating in the NourishDoc Referral program, as well as if you receive payment from NourishDoc for a Coach-related activity, you agree to these NourishDoc Coach Terms and Conditions (“Terms and Conditions”), which are in addition to the NourishDoc Terms of Service and Privacy Policy. To the extent the NourishDoc Terms of Service are inconsistent with these Terms and Conditions, these Terms and Conditions will control. Any capitalized terms that are not defined in these Terms and Conditions are defined as specified in the Terms of Service. In these Terms and Conditions, the words “including” and “include” mean “including, but not limited to.” Use of the term “you” or similar words (like “your”) refers in each instance hereunder to a Coach.

If you host Guided Experiences (including workshops, bootcamps, masterclasses, events, or group coaching sessions) through the NourishDoc platform, you are additionally subject to our Guided Experiences Terms and Conditions for Coaches, which are incorporated by reference into these Coach Terms and Conditions.

NourishDoc reserves the right to terminate, cancel, suspend, or modify any service or program, or the Terms and Conditions, at any time, in its sole discretion. If a significant change is made to the Terms and Conditions, we will provide reasonable notice either by email, by posting a notice in the Coach Dashboard, or otherwise by posting on the NourishDoc Services. By accessing the Services at any time after such changes, you are agreeing to those changes. You are advised to check the Terms and Conditions from time to time for any updates or changes that may impact you.

I. Coach Content

1. Coach Content Types and Ownership

1.1 Contributor Content

Coaches may voluntarily submit or participate in the creation of content including, but not limited to, interviews, podcasts, guest webinars, or educational snippets (“Contributor Content”). By doing so, you grant NourishDoc a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and sell such content in any format, without the need for further consent or compensation.

Contributor Content may be used individually or bundled with other content, and may be used to promote your own services or those of other Coaches within the same or related domains.

1.2 Coach-Owned Content

You retain full ownership of original instructional materials submitted for Guided Experiences or Wellness Certifications (“Coach-Owned Content”). By offering such content through NourishDoc, you grant a non-exclusive, worldwide license to host, market, and sell the content via the platform.

Revenue for Coach-Owned Content is shared based on the platform’s standard revenue share policy outlined below.

1.3 Commissioned Content

If a Coach is contracted by NourishDoc to create content under a separate agreement (such as a Statement of Work with “work-made-for-hire”), the Coach will be compensated as outlined in that agreement. Unless otherwise stated in writing, all content created under such an agreement (“Commissioned Content”) shall be the sole property of NourishDoc.

NourishDoc retains full and exclusive rights to use, reproduce, modify, distribute, bundle, sell, and sublicense the Commissioned Content, including the creation of derivative works. Scope, deliverables, and payment terms will be governed by the specific contract.

As between you and NourishDoc and to the extent permitted by applicable law, you retain ownership over and are responsible for any and all video, audio, text, photos, pictures, graphics, comments, and all other content, data, or information that you upload, store, transmit, submit, exchange, offer for sale, or make available to or via the Services (“Your Content”) except where the content is created on behalf of NourishDoc as a “work-made-for-hire,” at which point the content is owned by NourishDoc and is not Your Content. You agree that Your Content remains your sole responsibility. Your Content includes any content you have previously uploaded, stored, transmitted, submitted, exchanged, offered for sale, or made available to or via the NourishDoc platform. 

If you are a Coach engaged by NourishDoc, you agree to be subject to and abide by the Contract Coach Terms, which shall form part of this Agreement between you and NourishDoc. If you are a Coach who is employed or contracted by, volunteering for, or otherwise affiliated with an entity that contracts with NourishDoc to provide NourishDoc access to its employees or other affiliated individuals (a “Sponsor”, and accounts accessed under the Sponsor’s contract, “Sponsored Accounts”), you agree to be subject to and abide by the Third Party Coach Terms, which shall form part of this Agreement between you and NourishDoc.

A. Coach Content Requirements and Representations

 You are solely responsible for all Your Content that you post, including but not limited to videos, educational snippets, lectures, quizzes, exercises, tests, assignments, resources, answers, Guided Experiences, Wellness Certifications content, labs, assessments, and announcements. You will not upload, store, distribute, send, transmit, display, perform, offer for sale, make available, or otherwise communicate to the public any content (including any of Your Content) that you do not hold the necessary rights to. In particular, any unauthorized use of copyright protected works within Your Content may constitute an infringement of third party rights and is strictly prohibited. Any such infringements may result, among other things, in removal of your Content from the Service, termination of your access to the Service, and coverage by you of any resulting claims or damages.

You represent and warrant to NourishDoc as follows:

• • You are  currently certified or licensed in  the content/subject matter of Your Content. 
  • You have the required qualifications, credentials, and expertise (including education, training, licensing, knowledge, and skill sets) to teach and offer the services that you offer through Your Content and use of the Services;
  • Your Content is original work to you, or you have obtained all rights, licenses, consents, and permissions necessary in order for Your Content to be used as part of the Service, including the right to upload, reproduce, store, transmit, distribute, share, publicly display, publicly perform, offer for sale, make available (including for watching offline), otherwise communicate to the public, and sublicense Your Content.
  • Your Content and its availability on the Service does not and will not infringe or violate the rights of any third party, including any intellectual property rights, performers’ rights, rights of privacy or publicity, or any confidentiality-related restrictions.
  • You have obtained all necessary consents, permissions, and/or releases from anyone appearing in Your Content in order to include their name, voice, performance, or likeness in Your Content or to otherwise make available Your Content on the Service. You confirm that you will retain all original releases and maintain complete and accurate release records and shall share any such documents with NourishDoc upon request.
  • If Your Content includes third-party design elements, including fonts, clipart, sprites, vectors, and brush tools, the end user license agreement, terms of service, or the equivalent license held by you allows you to incorporate such elements in Your Content, and to license Your Content to NourishDoc on the terms herein.
  • If Your Content contains music, lyrics, and/or sound recordings, you own or have acquired all rights to use such music, lyrics, and/or sound recordings from the owner of the copyright of such music, lyrics, and/or sound recordings sufficient to permit the publication of Your Content on a NourishDoc owned and operated platform.
  • To the extent that Your Content contain identifiable third parties or landmark(s), you represent that you have obtained written consent and/or model and property release(s) of those third parties or landmarks pictured, to use such third party’s or landmark’s name or likeness and grant NourishDoc all of the license rights necessary to display Your Content on a NourishDoc owned and operated platform. You also warrant that each such third party has released you from any liability that may arise in relation to such use.
  • Your Content does not and will not create any liability on the part of NourishDoc, its subsidiaries, affiliates, successors, and assigns, and their respective employees, agents, directors, officers, and/or shareholders.
  • Your content complies with our Community Guidelines and Coaching Policies.

• Your coaching content is for educational and informational purposes only and does not constitute medical advice, diagnosis, or treatment. You will include appropriate disclaimers and encourage clients to consult healthcare professionals as needed.

Notwithstanding the fact that NourishDoc has no legal obligation to monitor the content on the Service, NourishDoc reserves the right to block, remove, or delete any content at any time, and to limit or restrict access to any content, for any reason and without liability, including if we have reason to believe that such content does or might infringe the rights of any third party, has been uploaded or posted in violation of these Terms and Conditions, our Terms of Service, our Community Guidelines, or applicable law, or is otherwise unacceptable to NourishDoc, in its sole discretion. NourishDoc reserves the right to remove Your Content, suspend or terminate your access to the Service, and/or pursue all legal remedies if we believe that any of Your Content infringes another person’s rights or violates any law, rule, or regulation.

B. NourishDoc Trademarks

While you act in the capacity of a Coach, and subject to the requirements below, you may use our trademarks (e.g. the NourishDoc name or any of the NourishDoc trademarks, logos, domain names, and other distinctive brand features, as well as the same for any other NourishDoc brands) solely as we authorize you to do so and solely in compliance with the following.

You must:

• use only copies of our trademarks that we specifically make available to you, as detailed in any guidelines we may publish;
• use our trademarks only in the creation or promotion of Guided Experiences, Wellness Certifications, or other content that you upload to our Service and that is created for the benefit of Clients; and
• immediately comply if we request that you make any changes or discontinue use.

You must not:

• use our trademarks in a misleading or disparaging way;
• use our trademarks in a way that implies that we endorse, sponsor, or approve of Your Content or services; or
• use our trademarks in a way that violates applicable law or in connection with an obscene, indecent, offensive, or unlawful topic or material.

C. The Rights Coaches Grant to NourishDoc

For Coaches Outside of the E.U. and the U.K.:

By agreeing to these Terms and Conditions, and by submitting Your Content to the Services or offering Your Content for sale on the Services, you grant to NourishDoc a worldwide, perpetual, fully sublicensable, non-exclusive right and license to use, reproduce, distribute, access, view, crop, resize, index, analyze, categorize, archive, copy, license, transmit, broadcast, publicly perform and publicly display, prepare derivative works incorporating, sell, advertise, and market any of Your Content in any form, medium, or technology, including any and all media now known or hereafter devised, for any lawful purpose, including the distribution of Your Content to NourishDoc customers and partners, to optimize the performance and operation of the Services, and/or to develop new features and products on or for the Service. You acknowledge and agree that the foregoing license rights are granted on a royalty-free basis.

You also grant NourishDoc a worldwide, perpetual, fully sublicensable, royalty-free, non-exclusive right to use your name, display name, image, likeness, and performance in connection with Your Content and other information, any features or functionality related to those materials or other information, as well as in connection with NourishDoc’s marketing and promotional activities and the sublicensing of Your Content in any and all media now known or hereafter devised without the payment of any compensation to you other than as described in the Coach Payment and Coach Referral sections below.

You authorize NourishDoc to sublicense these rights to Your Content to third parties, including to Clients or other users or viewers directly and through third parties such as partners, resellers, distributors, affiliate sites, and deal sites, which may include the use of your name, display name, image, likeness, performance, and/or Your Content for marketing and promotional activities carried out by the third party. You also give permission to NourishDoc to add, modify, or remove information related to Your Content in order to manage and license Your Content. This includes the right to add captions or otherwise modify Your Content to ensure accessibility.

NourishDoc, in the exercise of its discretion, may refrain from any or all of the foregoing without any liability to you. NourishDoc may advertise and/or market Your Content in any and all media now known or hereafter devised, including on social media platforms such as Facebook, Instagram, Pinterest, Twitter, LinkedIn, TikTok, YouTube, Giphy, Vimeo, Reddit, and Twitch, as well as similar sites and/or applications now known or hereinafter developed.

For Coaches In the E.U. and the U.K.:

By agreeing to these Terms and Conditions, and by submitting Your Content to NourishDoc or offering Your Content for sale on a NourishDoc owned and operated platform, you grant to NourishDoc, during the full term of protection, a worldwide, sublicensable, non-exclusive right and license to use, reproduce, distribute, access, view, crop, resize, index, analyze, categorize, archive, copy, license, transmit, broadcast, publicly perform and publicly display, prepare derivative works incorporating, sell, advertise, and market any of Your Content on (1) the Service (including a NourishDoc owned and operated platform); (2) a platform owned, managed, and/or hosted by a third party with whom NourishDoc has entered into a written agreement to host, display, and publicly perform content; or (3) on social media platforms such as Facebook, Instagram, Pinterest, Twitter, LinkedIn, TikTok, YouTube, Giphy, Vimeo, Reddit, and Twitch ((1) – (3) hereinafter referred to as “Content Platforms”), including the distribution of Your Content to NourishDoc customers and partners, to optimize the performance and operation of NourishDoc’s platform and services, and to develop new features and products.

You also grant NourishDoc a worldwide, non-exclusive right to use your name, display name, image, likeness, performance, and Your Content in connection with the submitted materials and other information, any features or functionality related to those materials or other information, as well as in connection with NourishDoc’s marketing and promotional activities and the sublicensing of Your Content, on all Content Platforms without the payment of any compensation to you other than as described in the Coach Payment and Coach Referral sections below.

You authorize NourishDoc to sublicense these rights to Your Content to third parties, including to Clients or other users or viewers directly and through third parties such as partners, resellers, distributors, affiliate sites, and deal sites, which may include the use of your name, display name, image, likeness, performance, and/or Your Content for marketing and promotional activities carried out by the third party. Remuneration for this sublicensing will be determined on a case-by-case basis and will be communicated to you prior to effectuation. You also give permission to NourishDoc to add, modify, or remove information related to Your Content in order to manage and license Your Content. This includes the right to add captions or otherwise modify Your Content to ensure accessibility.

NourishDoc, in the exercise of its discretion, may refrain from any or all of the foregoing without any liability to you.

For All Coaches:

Unless otherwise agreed, you have the right to remove all or any portion of Your Content from the Services and/or opt-out of the inclusion of Your Content in any sublicensing programs that NourishDoc enters into with third-party partners. To request such removal or opt-out, you must email NourishDoc at [email protected]. Your email must state your intention to remove Your Content and/or opt out and must specify the content that is related to your request, including a link to where it can be found on the Services. Except as otherwise agreed, NourishDoc will typically require at least 120 days to comply with your request and Your Content may remain on the Services and be included for sublicensing purposes in the interim. Notwithstanding any such request, NourishDoc’s right to use Your Content for marketing purposes shall survive termination or such removal, and any rights given to Clients before the removal of Your Content, will continue in accordance with the terms of those licenses (including any grants of lifetime access).

You will continue being paid, where applicable, until Your Content is removed, including during the period after you request removal or opt-out, but before we are able to effectuate that removal or opt-out, and we may continue distributing or marketing Your Content during this period.

II. Terms for Coaches

A. Applying to Coach

Absent permission from NourishDoc otherwise, all Coaches who have not previously published Guided Experiences or Wellness Certifications on the Service or offered other content or services may be required to submit an application in order to have the ability to publish Guided Experiences or Wellness Certifications on any platform that NourishDoc owns or operates or to offer other content or services. Approval of your application is not guaranteed. NourishDoc will determine, in its sole discretion, whether you are eligible to publish content to a NourishDoc platform or offer other content or services, without liability to you. Any information you include in your application will be processed in accordance with our Privacy Policy. Additional terms may be shared with you as part of the application process. By completing and submitting an application, you agree to those terms.

B. Terms of Conduct

When you publish Guided Experiences or Wellness Certifications on the Service or otherwise make use of the Service for purposes related to coaching, advising, or mentoring, you agree that:

• We set the price of a subscription to all or any part of the Service, and that price is subject to change, including with respect to taxes, all at our sole discretion;
• You will provide and maintain accurate account information;
• Guided Experiences, Wellness Certifications, or other content posted are publicly available to be viewed and accessed by any Client, unless otherwise specifically designated by NourishDoc;
• You grant us the right to place advertisements on Your Content at our sole discretion;
• You are qualified to provide the Guided Experiences, Wellness Certifications, or offer the content that you list with the Service and that you will at all times conduct yourself in a professional manner and in compliance with all applicable laws;
• You will maintain appropriate professional boundaries with Clients and adhere to ethical coaching standards;
• You will clearly communicate that your services are solely for wellness coaching purposes and do not replace professional medical, psychological, or therapeutic treatment;
• Your Clients may have the ability to post a review about (1) you; (2) any Guided Experience, Wellness Certification, or other content you publish; (3) any service that you offer on the Services; or (4) any content or other items you offer for sale. We cannot control the contents of any such review, and will not be held responsible for any information or opinions that a user may include in any such review;
• You may choose to remove material from your Guided Experiences, Wellness Certifications, or other content and will continue to own such content, but we will continue to have the right to use that content and to provide it to Clients who have paid for or enrolled in your Guided Experiences or Wellness Certifications; and
• To the extent any content is created on behalf of NourishDoc as a work-made-for-hire (for example, when we film and/or edit the content), you grant us full ownership of that content. It is at our sole discretion to remove, add, or edit such content.

You also agree that you will not:

• Submit any content to, or offer any content for sale on, the Service that violates, plagiarizes, misappropriates, or infringes the rights of third parties, including, without limitation, copyright, trademark rights, rights of privacy or publicity, confidential information, or any other third party material, or material that is subject to other third party rights, unless you have permission from the rightful rights holder in such material;
• Submit or offer for sale any content that is abusive, libelous, defamatory, pornographic, obscene, that promotes or incites violence, terrorism, illegal acts, or hatred on the grounds of race, ethnicity, cultural identity, religious belief, disability, gender, identity, or sexual orientation, or is otherwise objectionable in NourishDoc’s reasonable determination;
• Submit or offer for sale content that violates the NourishDoc Community Guidelines, which may be occasionally updated;
• Provide medical diagnosis, treatment, or advice, or claim to cure, treat, or diagnose medical conditions;
• Post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation through the Services or to any user;
• Use the Service for business other than providing coaching or related services to Clients;
• Use any data or other information you receive about Clients for any purpose other than providing your services to those Clients on the Service;
• Solicit additional personal data (beyond that described above) from Clients or store Clients’ personal data outside the Service; or
• Employ any techniques or make use of any services designed to misrepresent the popularity of Your Content on the Service, or to misrepresent your activity on the Service, including by the use of bots, botnets, scripts, apps, plugins, extensions, or other automated means to register accounts, log in, add followers to your account, play content, follow or unfollow other users, send messages, post comments, or otherwise to act on your behalf, particularly where such activity occurs in a multiple or repetitive fashion.

NourishDoc reserves the right, but is under no obligation, to delete any Guided Experience, Wellness Certification, or other content at any time and for any reason.

III. Coach Payments

When you offer Guided Experiences or Wellness Certifications on the Service you may be eligible to receive payments each month based on revenue earned from your digital products sold through our marketplace. The amount of payment you receive is determined by our Digital Products Terms and Conditions for Coaches Agreement and Marketplace Fee Policy which defines the applicable marketplace fees.

In order for you to earn payments during a month (“Coach Payments”), you must meet the following conditions:

1. You must comply with these Terms and Conditions and the Governing Documents; and
2. You must maintain active digital products available for purchase on the marketplace platform.

NourishDoc will pay out the Coach Payments for a particular month on month-end of the month following the time in which the revenue was earned. For new Coaches, Coach Payments begin the month following the month in which a Coach publishes their first Guided Experience or Wellness Certification on the Service (provided the conditions above are met).

Additional terms for participating in revenue opportunities can be found in the NourishDoc Digital Products Terms and Conditions for Coaches Agreement .

A. Payment for Additional Opportunities

NourishDoc offers now and/or may in the future offer several additional opportunities in which you may be eligible to participate. These opportunities may be able to help increase your revenue potential on NourishDoc. These opportunities include: engaging with Users on the platform; participating in NourishDoc-sponsored contests or giveaways; assisting other NourishDoc Coaches in various capacities; or via sublicensing or distribution opportunities. These additional opportunities, or other opportunities that may be developed in the future, may be limited to certain Coaches or groups of Coaches at NourishDoc’s sole discretion, and as a result, the earning opportunities for Coaches on the platform may differ from Coach to Coach. B. How Payments Work

NourishDoc makes all Coach Payments in U.S. dollars (USD) regardless of the currency with which the applicable transaction was made. NourishDoc is not responsible for any foreign currency conversion fees, wiring fees, or any other processing fees. For us to pay you for any Coach Payment, you must be registered with PayPal, our payment processor, be in good standing, and must keep us informed of the correct email associated with your account. You must also provide any identifying information or tax documentation (such as a W-9 or W-8) necessary for payment processing.

We use Stripe Checkout to process all payments on the platform. At month end, we provide payouts to Coaches using PayPal based on revenue earned per the marketplace digital products agreement, subject to meeting the minimum payout threshold of $25.00 USD.

Tax Responsibilities You are solely responsible for your own taxes and all tax-related obligations. NourishDoc does not withhold taxes or any other government regulation payments or fees from your Coach Payments. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that NourishDoc may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. You understand and agree that you are ultimately responsible for any taxes on your income.

Payment Requirements and Forfeiture If you do not register fully with PayPal and do not provide us with the necessary information and documentation, you will not earn any NourishDoc Coach Payments until you meet those requirements. Any NourishDoc Coach Payment you might have earned before meeting those requirements will be forfeited. Coach Payments that do not meet the minimum payout threshold will remain in your account until the threshold is reached.

Payment Processing and Disputes Information that you supply to PayPal is not stored by us or within our control, and is subject to PayPal’s own privacy policies and terms and conditions. NourishDoc is not responsible for fees, if any, charged by PayPal or other payment processors. NourishDoc disclaims all liability with regard to PayPal and any other payment processors. You have 30 days from the time at which a payment was or should have been made to report any discrepancies. After 30 days, you have waived your right to raise a dispute concerning that payment.

You agree that NourishDoc’s sole responsibility is to process payments and pay Coaches pursuant to the current payout model as defined in our marketplace digital products agreement. NourishDoc is not party to any transaction between any User and/or Coach and cannot be held responsible for any issues arising from any such transaction.

NourishDoc reserves the right to withhold or cancel payments to you if we deem, in our sole judgment and absolute discretion, that you engaged in behavior that violated any part of these Terms and Conditions, our Terms of Service, or our Community Guidelines or any other Governing Document.

If NourishDoc makes an overpayment of compensation to you for any reason, NourishDoc shall have the right to deduct the amount of such overpayment from your accrued NourishDoc Coach Payments or to demand the immediate repayment of such overpaid sums. NourishDoc may also recoup sums provided to you in connection with refunds or chargebacks by deducting applicable sums credited to your account.

If a User that has purchased content or a service from you files a dispute with their bank regarding your content or offering, we will fight the dispute on your behalf, though we may request information from you to assist us in doing so. You will be fully and solely responsible for the amount of the dispute, as well as a $15 USD dispute fee. These amounts will be withdrawn from and/or credited against any NourishDoc Coach Payments that you otherwise would have received, including future NourishDoc Coach Payments. If at the time of the dispute there are not enough funds connected with your NourishDoc Coach Payments to cover the fee and the disputed amounts, we may pull funds from your connected bank account or credit card, if any. NourishDoc may deactivate and/or remove from the Services Coaches who generate significant numbers of such disputes, at our sole discretion.

IV. Coach Affiliate Program

The NourishDoc Coach Affiliate Program (“Affiliate Program”) is a commission-based program available to Coaches who refer new Clients (“Referred Clients”) to NourishDoc using their unique affiliate link. Under this Affiliate Program, a Coach may earn a one-time commission for each Referred Client who purchases a NourishDoc membership through the Coach’s affiliate link.

To qualify as a Referred Client, the individual must be new to NourishDoc and must not have previously held a paid NourishDoc membership. A description of the current commission amount or percentage, eligibility criteria, and commission payment schedule is available in the Affiliate Terms and Conditions Agreement.

NourishDoc reserves the right to update the commission structure, eligibility requirements, or payout terms at its sole discretion.

C. Privacy

Participation in the Affiliate Program may require a Referred Client and/or a Coach to submit personal information about themselves. We will collect, process, and use that personal information in accordance with NourishDoc’s Privacy Policy. In addition, NourishDoc may use personal information to contact Coaches or Referred Clients with regards to participation in the Affiliate Program and to receive communications from NourishDoc or third-party administrators of the Affiliate Program.

V. Deleting a Coach Account

Coaches who wish to delete their account must submit a written request to the Company, and account deletion will take effect no sooner than sixty (60) days from the date of the request, during which time all scheduled sessions must be completed, financial obligations resolved, and any active commitments concluded. We’ll use commercially reasonable efforts to make any remaining scheduled payments that are owed to you before deleting your account. You understand that if clients have previously enrolled in or purchased Your Content, your name and that content may remain accessible to those clients after your account is deleted. If you need help or encounter difficulty deleting your account, you can contact us via our Help Center.

If you would like Your Content removed from any NourishDoc-related sublicensing arrangement, please see Section I.C. above and follow the instructions specified there.

VI. Coach-Specific Disclaimers and Waivers

While NourishDoc Terms of Service includes a general waiver of liability for all Users, Coaches are solely responsible for determining whether additional informed consent, disclaimers, or waivers are necessary for any or all the Guided Experiences or Wellness Certifications they provide. Coaches may present Users with additional waivers, consents, or agreements as needed, provided such documents do not conflict with these Terms or any applicable law. NourishDoc is not a party to such additional agreements and bears no responsibility for their enforcement, content, or use.
